Feds will appeal release of Mich. militia members

DETROIT –

Federal prosecutors in Detroit say they're appealing the release of nine jailed members of a Michigan militia.

They filed a one-page notice Wednesday. It will be up to a judge to decide whether to continue to keep the release of the militia members on hold or send them home pending the appeal.

The nine are charged with conspiring to wage war against the government. U.S. District Judge Victoria Roberts ordered their release until trial Monday but suspended her decision until prosecutors could tell her about an appeal.
