Mich. high court considers new recusal rules

LANSING, MI – The Michigan Supreme Court is considering formal rules for when justices should step aside from hearing cases.

The disqualification issue has been a bone of contention for several years. The high court has an unwritten tradition that leaves it up to each justice to decide if he or she should recuse himself or herself.

Under one proposal, all the justices could review if a colleague should be disqualified. Another idea is letting justices decide for themselves as long as they give their reason in writing.

A public hearing on the proposed rules will be held Wednesday at the court.
