DETROIT –
Michigan has pledged to appeal after a court struck down the state's ban on the consideration of race and gender in college admissions.
The 6th U.S. Circuit Court of Appeals said Friday in a 2-1 decision that the law, approved by voters in 2006, burdens minorities and violates the U.S. Constitution.
Michigan Attorney General Bill Schuette says he will ask the full appeals court to look at the case, a request that's rarely granted.
The American Civil Liberties Union hailed the court's decision.
It was part of a coalition that challenged the Michigan ban. Jennifer Gratz is a Michigan native who successfully sued the University of Michigan over racial preferences before the 2006 referendum. She predicted the decision eventually will be thrown out.
